This AI Tools and Features Disclaimer (the “Disclaimer”) is issued by Kohle Capital Markets Limited (the “Company”, “we”, “us”, or “our”), operating under the KCM Trade brand and regulated by the Financial Services Commission of Mauritius (FSC Mauritius) under Licence No. C117022600 (Investment Dealer, Full Service Dealer, SEC-2.1B).

This Disclaimer applies to all artificial intelligence-powered tools, features, and assistants made available through the KCM Trade website, trading platform, and mobile applications (collectively, “AI Features”), including but not limited to:

AI Mentor — AI-powered educational and informational assistant
Analyze Trading — AI-generated analysis of trading patterns and account activity
AI News — AI-aggregated and AI-summarised market news
Economic Events — AI-processed economic calendar and event data
IB Promo Generator — AI-assisted promotional content generation tool for Introducing Brokers

By accessing or using any AI Feature, users acknowledge that they have read and accepted this Disclaimer in full.

AI Features are available only to users who are eligible to access the Services under the Company’s Terms of Service and Client Appropriateness Policy. AI Features must not be used by persons under the age of 18 or by persons in jurisdictions where access to the Services is restricted or prohibited.

1. No Financial Advice

The AI Features do not constitute regulated financial advice, investment advice, personal recommendations, or financial planning services.

Outputs generated by any AI Feature — including trade analysis summaries, market commentary, economic event interpretations, mentor guidance, and promotional content drafts — are provided for general informational and educational purposes only. They must not be relied upon as the basis of any investment, trading, or financial decision.

The Company is licensed as an Investment Dealer by the FSC Mauritius. The AI Features are technology tools — not a regulated advisory service. Nothing in or produced by any AI Feature creates an advisory relationship between the Company and the user.

Users requiring personalised financial advice should consult an appropriately licensed and independently regulated financial adviser.

2. Inherent Limitations of AI-Generated Output

AI systems generate outputs based on patterns, training data, and probabilistic models. By their nature, AI outputs:

May be incomplete, inaccurate, or out of date and do not constitute verified factual information
May not reflect recent market events, regulatory changes, or breaking news that occurred after the AI’s training or data cutoff
May contain hallucinations — outputs that are plausible-sounding but factually incorrect, including invented data, fabricated statistics, or inaccurate market information
Are not based on a complete or verified understanding of any individual user’s financial situation, investment objectives, experience level, or risk tolerance
Do not replace independent research, professional human expertise, or verified primary data sources

The Company makes no warranty as to the accuracy, completeness, fitness for purpose, or reliability of any AI Feature output. Users must exercise independent judgement and are solely responsible for their own trading, investment, and financial decisions.

3. AI Mentor

The AI Mentor is an AI-powered educational and informational assistant available on the KCM Trade website and application. Use of the AI Mentor is additionally governed by the KCM AI Mentor Services Terms & Conditions (the “AI Mentor T&Cs”). In the event of any inconsistency between this Disclaimer and the AI Mentor T&Cs in relation to the AI Mentor specifically, the AI Mentor T&Cs prevail.

3.1 Nature of the Service

The AI Mentor generates outputs automatically using AI technology based on data and parameters provided by users or sourced by the system. Outputs — including reports, results, feedback, and guidance — are provided for informational and analytical purposes only and may contain estimations, interpretations, or predictions based on historical data.

The AI Mentor provides general guidance on trading concepts, financial market terminology, platform navigation, and educational topics
Responses are not personalised to any individual user’s trading account, open positions, financial circumstances, or risk profile
The AI Mentor is not a financial adviser and does not constitute a substitute for professional financial, legal, or other advice
Users must not place trades, make investment decisions, or take financial actions based solely or primarily on AI Mentor outputs

3.2 Acceptance of Terms

By accessing or using the AI Mentor, users confirm they have read, understood, and agreed to the AI Mentor T&Cs and this Disclaimer. If you do not agree, you must refrain from using the AI Mentor.

3.3 Accuracy and Reliability

The Company strives for accuracy but — given the nature of AI — outputs may contain errors, inaccuracies, or incomplete information. The Company makes no representations or warranties regarding the accuracy, completeness, or suitability of AI Mentor outputs. Users must independently verify any material information before acting on it.

3.4 User Responsibility

Users agree that:

Use of the AI Mentor is at the user’s own risk
The Company is not liable for any decisions or actions taken based on AI Mentor outputs
The AI Mentor will be used for lawful purposes only
Users will not rely solely on the AI Mentor for critical business, financial, or personal decisions without independent verification

3.5 Intellectual Property

The AI Mentor service, including all related data, content, and intellectual property, is the property of Kohle Capital Markets Limited or its licensors. Users are granted a non-exclusive, non-transferable, revocable licence to use the AI Mentor for personal or internal business use only. Reproduction, distribution, or modification of AI Mentor outputs without prior written consent is prohibited.

3.6 Indemnification

Users agree to indemnify, defend, and hold harmless Kohle Capital Markets Limited, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or related to their use of the AI Mentor or any violation of the AI Mentor T&Cs.

3.7 Changes to AI Mentor Terms

The Company reserves the right to modify the AI Mentor T&Cs at any time. Changes take effect upon posting. Continued use of the AI Mentor after any amendment constitutes acceptance of the revised terms.

4. Analyze Trading

The Analyze Trading feature provides AI-generated analysis and summaries of a user’s trading patterns, position history, and account activity.

Analysis outputs are based on historical account data and general market indicators; they do not constitute predictions of, or projections about, future performance
Analyze Trading outputs are descriptive and statistical in nature and do not constitute a recommendation to open, close, modify, or hold any position or instrument
The Company does not warrant that analysis outputs accurately reflect current market conditions, are error-free, or are suitable for use as a decision-making tool
Past performance reflected in any analysis output is not a reliable indicator of future results
Where copy trading account or strategy data is included in Analyze Trading outputs, the historical performance of any copied strategy does not constitute an indication of results achievable in the future; losses of a copied strategy are also replicated and past strategy performance must not be treated as a guide to future replication outcomes
Users bear sole responsibility for any trading decision made following review of an Analyze Trading output

5. AI News

The AI News feature aggregates, summarises, and presents market news and financial headlines using AI processing and third-party data providers.

News content is sourced from third-party providers and processed or summarised by AI; the Company does not independently verify the accuracy of all third-party source content
AI summaries may not capture the full context, nuance, or material caveats present in the underlying source article
There may be a delay between an event occurring and that event being reflected in AI News outputs
The Company accepts no liability for any loss, damage, or adverse trading outcome arising from reliance on AI News content
Users should verify material market information from primary or authoritative sources before acting upon it

Note on counterparty interest: As an FX and CFD broker operating a market-maker model, the Company may act as principal counterparty to trades executed through the Services. The Company may therefore have a direct financial interest in the outcome of trades placed in response to information displayed in AI News. Users should be aware of this potential conflict of interest and are encouraged to consult the Conflicts of Interest Policy and Regulatory and Licensing Disclosure.

6. Economic Events

The Economic Events feature provides AI-processed information about scheduled economic data releases, central bank decisions, and geopolitical announcements.

Economic event data, release times, and consensus forecasts are sourced from third-party providers; the Company does not independently verify the accuracy of this data and it may be subject to revision or late changes
Projected or consensus values displayed are third-party forecasts; they do not represent the Company’s own forecasts and are not guaranteed to be accurate
Actual economic data may differ materially from prior forecasts; such differences can cause rapid and significant price movements in financial instruments
The Company accepts no liability for any loss arising from a user’s trading decisions made in connection with economic events information displayed in this feature
Users trade economic events at their own risk

Note on counterparty interest: As an FX and CFD broker operating a market-maker model, the Company may act as principal counterparty to trades placed in anticipation of or reaction to economic data releases. The Company may therefore have a direct financial interest in the outcome of such trades. Users should review the Conflicts of Interest Policy and Regulatory and Licensing Disclosure.

The IB Promo Generator is an AI-powered tool that enables Introducing Brokers (IBs) and authorised partners to generate draft promotional content and marketing material templates.

7.1 Draft Content Only

The IB Promo Generator produces draft content only. Generation of content by the tool does not constitute the Company’s review, approval, endorsement, or sign-off of any specific piece of promotional material for publication.

7.2 IB Compliance Responsibility

IBs and authorised partners are solely and entirely responsible for reviewing, modifying, approving, and ensuring the regulatory compliance of all content generated using the IB Promo Generator before it is published, broadcast, or distributed in any form.

Before publishing any AI Promo Generator output, the IB or partner must ensure that the content:

Includes the mandatory risk warning as specified in the Company’s Marketing and Advertising Compliance Policy
Does not contain guarantees of profit, exaggerated performance claims, or misleading statements (see §4.2 of the Marketing and Advertising Compliance Policy)
Complies with all applicable local laws, financial promotion regulations, and consumer protection requirements in the IB’s or partner’s jurisdiction
Accurately represents the Company’s products, services, fees, spreads, and trading conditions as currently stated in the Company’s official documentation
Complies with the advertising policies of the platform on which the content will be published

7.3 No Liability for Published IB Content

The Company accepts no responsibility or liability for any loss, regulatory action, fine, claim, or reputational damage arising from the publication of content generated using the IB Promo Generator. IBs and authorised partners agree to indemnify and hold the Company harmless against all third-party claims and regulatory actions arising from the publication of content generated through this tool.

8. AI-Generated Advertising Content (Company Use)

Where the Company itself uses AI tools to generate advertising and promotional content — including AI KOL personas, AI-generated graphics, AI-generated video, and AI-assisted copy — all such content is subject to the standards, disclosure requirements, and approval process set out in the Company’s Marketing and Advertising Compliance Policy.

Users who encounter Company-produced AI-generated advertising content may rely on the following:

AI KOL personas used by the Company are disclosed as AI-generated, not real human individuals
All AI-generated promotional content has been reviewed and approved by the Company’s compliance function prior to publication
Mandatory risk warnings are included in all AI-generated promotional materials where required

9. Data and Privacy

The AI Features may process certain user-provided data and trading account data to generate personalised outputs. Processing of personal data in connection with AI Features is conducted in accordance with the Company’s Privacy Policy and Data Safety and Processing Disclosure.

Users must not input sensitive personal information — including government-issued identification numbers, passwords, financial account credentials, or third-party confidential information — into any AI Feature prompt, chat interface, or input field.

The AI Features may utilise third-party AI model and technology providers, including OpenRouter (an AI model gateway) and the underlying AI model providers that OpenRouter routes requests to. Users’ inputs and related data processed through AI Features may be transmitted to those third-party providers in accordance with their applicable terms. These providers operate as sub-processors under the Company’s data processing arrangements. Users should review the Data Safety and Processing Disclosure and Privacy Policy for details of the Company’s sub-processor relationships.

Certain AI Features are account-aware — for example, features that review a user’s positions, perform a pre-trade check, or provide account-based guidance. Where a user invokes such a feature, the Company transmits relevant trading account data — which may include account balance, equity, open positions, profit and loss, and trade history — to the AI sub-processor in order to generate the requested output. This data is transmitted solely to service the user’s request, is not used by the Company to provide personalised financial advice or a recommendation, and is subject to the cross-border transfer safeguards described in the Privacy Policy. Market data, signals, sentiment, economic-calendar, and news content presented within or alongside the AI Features is sourced from independent third-party providers (including Acuity Trading and Financial Modeling Prep); the Company does not generate this data and does not guarantee its accuracy, completeness, or timeliness.

10. Availability and Modification

The AI Features are provided on an “as is” and “as available” basis. The Company reserves the right to:

Modify, suspend, or discontinue any AI Feature at any time without prior notice
Update AI models, algorithms, or data sources, which may alter the nature or quality of outputs
Restrict access to AI Features from certain jurisdictions or user categories in compliance with applicable regulatory requirements

11. Limitation of Liability

To the fullest extent permitted by applicable law, the Company excludes all liability — including for direct, indirect, consequential, or financial loss — arising from:

Reliance on any AI Feature output for any trading, investment, or financial decision
Errors, inaccuracies, omissions, or hallucinations in AI Feature outputs
Temporary or permanent unavailability of any AI Feature
The publication of IB Promo Generator outputs by an IB or partner without appropriate compliance review
Unauthorised access to or misuse of AI Feature outputs by third parties

This exclusion is in addition to, and does not restrict, the general limitation of liability set out in the Company’s Terms of Service.

12. Governing Law

This Disclaimer and all matters arising out of or in connection with the AI Features are governed by and construed in accordance with the laws of the Republic of Mauritius, without regard to its conflict of law principles, consistent with the AI Mentor T&Cs (§11) and the Company’s Terms of Service.

Any dispute arising out of or in connection with this Disclaimer shall be subject to the exclusive jurisdiction of the courts of the Republic of Mauritius, unless otherwise required by applicable mandatory law in the user’s jurisdiction.
